本件放送は、ＳＴＡＰ細胞の正体はＥＳ細胞である可能性が高いこと、また、そのＥＳ細胞は、若山研究室の元留学生が作製し、申立人の研究室で使われる冷凍庫に保管されていたものであって、これを申立人が何らかの不正行為により入手し混入してＳＴＡＰ細胞を作製した疑惑があるとする事実等を摘示するものとなっている。これについては真実性・相当性が認められず、名誉毀損の人権侵害が認められる。
こうした判断に至った主な原因は、本件放送には場面転換のわかりやすさや場面ごとの趣旨の明確化などへの配慮を欠いたという編集上の問題があったことである。そのような編集の結果、一般視聴者に対して、単なるＥＳ細胞混入疑惑の指摘を超えて、元留学生作製の細胞を申立人が何らかの不正行為により入手し、これを混入してＳＴＡＰ細胞を作製した疑惑があると指摘したと受け取られる内容となってしまっている。
BPOです。大きな決定です。
小保方氏の名誉は回復されなければなりません。ただ、「だからSTAP細胞はある」「研究不正はなかった」ということにならないことを願います。
